The act of recognition of paternity. A voluntary decision? Analysis of practical cases

Introduction: Voluntary acknowledgment is the process of establishing the legal relationship between a father and his child. However, there are situations where the act of recognition can be flawed, affecting the legitimacy of the voluntary act. The challenge to the act of paternity recognition becomes a critical issue in family law.
Objective: Analyze judicial decisions issued by the Ecuadorian justice system to identify the action to challenge the act of recognition of paternity.
Methods: Case studies in the province of Chimborazo using an inductive, analytical, and descriptive approach, bibliographic review of the jurisprudence of the National Court of Justice, and dissemination of the results.
Results: The analyzed cases revealed specific procedures for challenging the act of paternity recognition, highlighting the importance of evidence. Effective legal methods were also identified to demonstrate acts flawed by consent, clearly differentiating between the challenge to the act of recognition and the challenge to paternity.
Conclusions: The existence of flaws in the act of paternity recognition underscores the need to reinforce verification and control procedures. It is important to implement preventive and corrective measures to ensure the integrity of the process and the parties involved.
