The Effectiveness of the Extraordinary Protection Action as a Jurisdictional Guarantee

The Constitution of the Republic of Ecuador of 2008 introduced significant innovations to protect fundamental rights, including the Extraordinary Action of Protection, which is established in article 94 of the Constitution and developed in the Organic Law of Jurisdictional Guarantees and Constitutional Control, allows you to challenge judicial rulings that violate constitutional rights, acting as a last resort after exhausting all ordinary and extraordinary remedies. This constitutional action corrects injustices and ensures that judicial decisions respect constitutional rights, providing a means to remedy violations that have not been adequately addressed by other judicial bodies. Although its implementation faces challenges, such as the overload of work in the Constitutional Court and the lack of knowledge about its use, the AEP has proven to be effective in protecting fundamental rights and strengthening the rule of law in Ecuador. It is crucial to improve its implementation and accessibility to maximize its impact and ensure its sustainability, consolidating it as an essential pillar in the protection of human rights in the country.
